These Terms of Service (“Terms”) govern your access to and use of all websites, applications, APIs, and services operated by Excalibur Web Services (collectively, the “Services”), including but not limited to our individual products such as Snaptide and any future offerings (“Products”).

By accessing or using any of our Services or Products, you (“User”, “you”) agree to be bound by these Terms.
If you do not agree, please stop using our Services immediately.

1. Acceptance of Terms

By accessing, registering for, or using the Services, you confirm that:

You have the authority to enter into these Terms.
You will comply with all applicable laws and regulations.

2. Scope of Services

Excalibur Web Services provides a platform offering multiple digital products, APIs, and web services.
These Terms apply to all Services unless explicitly overridden by Product-Specific Terms (“Product Terms”).

Using any individual Product (e.g., Snaptide) constitutes acceptance of both:

These General Terms of Service
The Product Terms applicable to that specific Product (if provided)

In case of a conflict, Product Terms override the general Terms for that product only.

3. Account Registration

To use certain Services, you may need to create an account. You agree to:

Provide accurate and complete information.
Maintain confidentiality of your login credentials.
Immediately notify us of unauthorized access.

You are responsible for all activities under your account.

4. Licensed Use

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for lawful purposes.

You agree not to:

Reverse engineer, copy, or modify the Services
Use automated systems (unless permitted via official APIs)
Attempt to bypass security or access unauthorized areas
Resell, lease, or sublicense our Services without permission

5. Product-Specific Terms

Some Products (e.g., Snaptide’s cloud storage, facial recognition API, developer APIs, authentication services, etc.) may have:

These are stated in each Product’s Product Terms or within the Product dashboard.

By using a Product, you accept those additional terms.

6. Billing & Payments

If you purchase a paid plan or subscription:

Fees are due as stated at checkout.
Renewals occur automatically unless cancelled.
Taxes may apply depending on your jurisdiction.

We may change pricing with advance notice via email or Service announcement.

Failure to pay may result in suspension or termination of access.

7. User Content

Some Products allow you to upload, store, or process content (“User Content”).

You retain ownership of your content.
By using the Services, you grant us a license to:

Store, host, process, transmit, and display your content
Perform operations needed to provide the Services
Generate derived data as permitted in our Privacy Policy

We do not claim ownership over your photos, files, or data.

You are responsible for ensuring User Content does not violate any laws or rights.

8. Data & Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

Using the Services constitutes acceptance of the Privacy Policy.

Some Products may also include Product-Specific privacy terms (e.g., Snaptide’s face recognition data handling rules).

9. Availability & Service Modifications

We strive for high uptime but do not guarantee uninterrupted availability.

We may:

Update or modify features
Add or remove functionalities
Discontinue or replace any Product

If a Product is discontinued, we will provide reasonable notice and data export options.

10. Prohibited Activities

You agree not to use the Services to:

Violate any law
Upload harmful, offensive, or illegal content
Circumvent rate limits or misuse APIs
Scrape or extract data without permission
Engage in harassment, fraud, or security breaches

Violation may lead to termination.

11. Intellectual Property

All trademarks, logos, software, and content belonging to Excalibur Web Services are our exclusive property.

Nothing in these Terms grants you rights to our IP unless expressly permitted.

12. Third-Party Services

Some Services integrate with third-party tools.
We are not responsible for their:

Content
Policies
Security
Functionality

You are responsible for reviewing third-party terms.

13. Termination

We may suspend or terminate your access to the Services if you:

Misuse the Services
Fail to pay for paid plans
Cause harm or legal risk

Upon termination, your license ends, and we may restrict access to your data as permitted by law.

14. Disclaimer of Warranties

15. Limitation of Liability

Excalibur Web Services is not liable for indirect, incidental, or consequential damages.
Our total liability for any claim will not exceed the fees paid by you in the past 12 months.

You agree to indemnify and hold harmless Excalibur Web Services from claims arising from:

Your violation of these Terms
Your User Content
Your infringement of any law or rights

17. Governing Law

These Terms are governed by the laws of India, specifically the jurisdiction of Bathinda, Punjab, unless otherwise required by applicable law.

We will notify you via email or dashboard when changes are significant.

Continued use after changes constitutes acceptance.
